Charles Coleman, leading litigator and director at Gough Law, will be taking part in a panel discussion at the 4th Annual Offshore Alert conference being held in London on the 23rd and 24th November. Attended by 250 clients, providers, and investigators of high end financial products, the event provides a neutral forum for senior stakeholders in all areas of high-value international finance from the UK, Europe, the USA, Canada and key offshore jurisdictions.
Together with specialist litigator Simon Thomas of Baker Partners in Jersey, they will be discussing the topic “professional, nominee and Independent Directors: are they untouchable?”. Charles has extensive experience of suing and defending cases against offshore directors, particularly in the insolvent fund context, and topics discussed will include developments following the judgments in the Cayman Court relating to the insolvent Weavering Macro fund. In that case, (subsequently overturned on appeal) the Judge found that the directors had breached their duties as directors of the Weavering Macro fund, but also offered general guidance on what duties Directors of offshore funds are under, with a particular focus on administration, structuring and valuing hedge funds and their assets. The question following the successful appeal, delivered earlier this year, is whether that judgment still offers good guidance to directors of offshore funds regarding their duties. Other topics include tactics for recovering against Directors and Officer’s insurance and obtaining evidence to prosecute claims against funds and directors.
