?300 million case to be fought on Island

Manx advocates Cains is representing an investment company in a ?300 million court case over development projects in India.
The case will be fought on the Island after the Manx High Court’s Staff of Government Division ruled courts here have jurisdiction to hear it.
The property investment fund Hirco is suing Indian businessman Niranjan Hiranandani – its former chairman - and his daughter Priya, the company’s former chief executive.
Hirco claims it invested ?350 million based on misinformation from the two, which they deny, and is alleging fraud and misconduct.
Mr Hiranandani and his daughter had fought to have the case heard in India, saying the Isle of Man courts didn’t have the jurisdiction to hear the claims.
But dismissing the appeal Deemster Doyle said because the company is registered here, Manx courts have a legitimate interest in hearing claims of fraud and breaches of directors’ duties.
Mr Hiranandani is hoping to be given permission to appeal to the Privy Council over the decision – meaning the case may yet move elsewhere.
Shares in Hirco were suspended on the Alternative Investment Market last year – and it delisted from the market in February.
