Small claims available again for LImited Companies

by isleofman.com 19th July 2006
Its been described by its author as " a victory for common sense" and it certainly will be applauded by small businesses, seeking help in getting money owed to them.

John Houghton, the North Douglas MHK's private members bill,
permitting Limited Companies the ability to make application through the High Court to lodge claims at small claims arbitration, has been given the thumbs up by Tynwald.

Last year a ban was put on these companies submitting to the small claims court, and that was greeted with dismay by many small businesses who would have been forced to seek legal help and recourse to the courts to settle differences over payment.

This is for modest claims, up to ?5000. But this measure now seen through Tynwald by John Houghton will allow the businesses to recoup debts " which in Mr Houghtons own words " would not have been economical whilst having to employ an advocate."
