A Pulrose man found guilty on two counts of causing death by dangerous driving will find out on Thursday whether an appeal against the severity of his seven year prison term has been successful.
At today's appeal court hearing Shaun Webb's advocate argued the sentence reflected a high degree of culpability, when only one of a long list of aggravating factors, namely excessive speeding, could be applied in the case.
He said the case was an "intermediate" one, for which a four year term would have been more appropraite.
The prosecution argued that in crashing his car at a hundred miles an hour, when he had no licence or insurance, Webb had displayed a "cavalier" attitude, and there was no question of the sentence being "manifestly excessive", as had been claimed.
The accident happened on Ballamodha Straight in October 2003 and resulted in the deaths of fifty-seven year old Elizabeth Jane Corlett, of St Mark's and her eighty-three year old mother, Elaine Gawne.
