The Cape High Court in South Africa has rejected an application from a pharmaceuticals company claiming a seizure of generic viagra destined for the Isle of Man was unlawful.
BCC Pharmaceuticals is accused of supplying illegal versions of the anti-impotence drug to an Isle of Man company.
The company’s managing director Stuart Bassett told the court the medicines were samples which were intended to be sent to the Isle of Man in response to an offer from a manufacturer in 2002, but he later found out his contact dealt in counterfeit drugs.
Department of health inspector Lionel Snyman said the company wasn’t allowed to import or export drugs without a licence.
Justice Dennis Davis said there was a reasonable suspicion the drugs were unlawful and dismissed the application.
