A man who claimed BA CitiExpress had been negligent after injuring his back while removing stickers has had his case thrown out.
Keith MacFarlane was working for the company in July 2004 when he was asked to remove security stickers from a rear aircraft door.
Instead of finding a stand to reach the door, he stretched upwards and strained a muscle in his back.
He claimed the airline had failed in its duty of care as stands hadn’t been adequately provided and he hadn’t been trained properly.
Deputy Deemster Corlett was told by former BA CitiExpress staff that stands were available just forty metres away.
The court also heard all staff had been given health and safety training as well as a copy of a handbook detailing procedures.
Deputy Deemster Corlett said he considered Mr MacFarlane had been entirely to blame for his own injury and his conduct was the sole cause of the damage. He dismissed the case and ordered Mr MacFarlane to pay costs for BA CitiExpress.
